Seattle DUI Attorney | Know Your Rights

I’ve written articles about this before, but every day I continue to hear and see stories of people that, had they just done what they could do, just exercised their rights properly, could have avoided trouble or significantly increased their leverage in their case. See, I’m a Seattle DUI attorney. People that need my help have been arrested for driving under the influence.

The key to minimizing the damage of a DUI arrest is knowing what you can and can’t do when confronted by the cops. It’s not rocket science, but it’s important to have thought about what you would do and can do when faced with a situation like this so, god forbid it ever happens, you know what to do.

Remember, by the way, as the title implies, this article applies only to people in trouble in the State of Washington. If you are in other places you may have different rules to follow.

There are generally four things you need to remember if you are confronted by the cops. First, you need to keep your mouth shut. Cops aren’t trying to be your friend, they are trying to build a case against you. Talking lets them determine if your breath smells like alcohol, lets determine if your speech is slurred, and lets them learn about whatever you’ve been doing that night.

Second, and third, you don’t ever want to take field sobriety tests or a portable breath test. You don’t have to, and you are never going to pass the tests. This is another way for the cops to get more information from you. Are you swaying? Can you pay attention? Can you walk a line? And none of these things have anything to do with driving.

And, finally, if you get the opportunity, call a Bellevue DUI attorney as soon as the officer reads you your rights. Talk to someone before you decide to take the breath test. Talk to them so they can gauge your sobriety and ask them the questions you want to know.
